PRIVACY POLICY

This Privacy Policy ("Policy") applies to the use of the Mishiyo mobile application (available on  
Android via the Google Play Store and on iOS via the Apple App Store) and web-based interface  
(together, the "Platform").  
The Platform is operated by Shiviksha Health Tech Private Limited, a company incorporated under the  
Companies Act, 2013, with its registered office at No. 2090, 16th Cross, 23rd Main Road, Sector 1,  
HSR Layout, Bangalore South, Bangalore- 560102, Karnataka, India (hereinafter referred to as  
"Mishiyo", "Company", "us", "we", or "our"). Through the Platform, Mishiyo provides curated  
educational and awareness content on infant and child health and parenting, an online teleconsultation  
marketplace connecting parents and caregivers with independently licensed medical Practitioners,  
digital child wellness tracking tools, automated health reminders, and an AI-powered wellness chatbot  
(collectively, the "Services") as defined further in detail in the Terms and Conditions of the Platform  
(“Terms”).  
This Policy reflects our commitment to protecting the privacy and Personal Information of all users of  
the Platform, and particularly the personal data of minor children stored in Child Profiles. We are  
committed to protecting and respecting your privacy in accordance with the Digital Personal Data  
Protection Act, 2023 ("DPDPA"), the Information Technology Act, 2000, and all other applicable data  
protection laws of India.  
For the purposes of this Policy, wherever the context so requires, "you", "your", "yourself", or "user"  
shall mean any person who uses the Platform, including the Primary Account Holder (being the mother  
or legal guardian of the child) and any Sub-User granted access by the Primary Account Holder.  
Terms not defined herein shall have the meaning ascribed to them in our Terms for the Platform. By  
using the Services, you agree and accept the application of this Policy.  
BY USING THE PLATFORM OR BY OTHERWISE PROVIDING US WITH YOUR  
INFORMATION OR THE INFORMATION OF YOUR CHILD, YOU WILL BE DEEMED TO  
HAVE READ, UNDERSTOOD, AND AGREED TO THE PRACTICES AND POLICIES  
OUTLINED IN THIS POLICY AND YOU HEREBY CONSENT TO OUR COLLECTION, USE,  
STORAGE, AND SHARING OF YOUR INFORMATION AND CHILD PROFILE DATA AS  
DESCRIBED IN THIS POLICY. IF YOU DO NOT AGREE WITH THIS POLICY AT ANY TIME,  
DO NOT USE ANY OF THE SERVICES OR PROVIDE US WITH ANY OF YOUR  
INFORMATION.  
1. INFORMATION GATHERED  
1.1 Account and User Information  
To access the Platform, you may be required to register and create an Account. In doing so, you may  
be required to provide certain information that can be used to identify you ("Personal Information"),  
which may include:  
name;  
gender;  
phone number;  
email address;  
location of residence or access;  
profile picture; and  
any other information voluntarily provided or required for accessing the Services.

1.2 Child Profile Data  
The Primary Account Holder may create one or more Child Profiles on the Platform. Data entered into  
a Child Profile constitutes Personal Information relating to a minor child and is treated by the Company  
as Personal Data. Such data may include:  
the child's name, date of birth, gender, and birth weight;  
growth measurements, including weight, height, and head circumference, entered manually;  
sleep logs, including sleep start and end times, duration, and sleep patterns;  
feeding logs, including timing, duration, and type (breastfeeding, bottle, solid food);  
stool and hygiene observations as entered by the parent or caregiver;  
known allergies, medical conditions, and current medications as entered by the parent;  
photographs or videos of the child uploaded by the Primary Account Holder;  
vaccination records and health check-up dates as entered by the parent; and  
any medical history, notes, or records shared with a Practitioner during or in connection with a  
Consultation.  
Child Profile data is processed solely for the purposes of providing the Platform's Services and is never  
used for advertising, behavioural profiling, or commercial purposes unrelated to the Services.  
1.3 Device and Demographic Information  
Depending on your interaction with the Platform, we may collect the following technical and usage data  
("Demographic Information"):  
device information, including operating system, device model, and IP address;  
platform of access (mobile application or web interface);  
platform activity logs and session data;  
crash reports and diagnostic data; and  
cookies (subject to consent) for improving user experience on the web interface.  
1.4 Payment Information  
Where you purchase a Subscription or book a Consultation, we may access certain financial  
information, such as the payment method and transaction identifier, to facilitate completion of payment.  
All payment transactions are processed through third-party payment gateway providers who have their  
own privacy policies and security practices. The Company does not store complete card numbers or  
bank account credentials. We recommend that you review the privacy policy of the applicable payment  
gateway provider before submitting financial information.  
1.5 Consultation Records  
Where you book a Consultation with a Practitioner through the Platform, information exchanged during  
or in connection with the Consultation, including appointment details, consultation notes, prescriptions  
issued, and records uploaded; may be recorded and stored on the Platform. You acknowledge that  
authorised Company personnel may review Consultation records for the purposes of quality assurance,  
legal compliance, and service improvement, in accordance with this Policy.  
1.6 AI Wellness Assistant Data  
Queries and responses generated during interactions with the AI Wellness Assistant may be logged by  
the Company in anonymised or pseudonymised form for the purpose of improving model accuracy and  
safety. Such logs are retained for a maximum of twelve (12) months and are not used for advertising or  
disclosed to third parties.  
1.7 Third-Party Personal Information  
Should any Personal Information submitted by you include the Personal Information of any other person  
(including the other parent or caregiver of the child), as between you and Mishiyo, you shall be  
responsible for securing the necessary consent of such other person for the incidental storage and use  
of such information by Mishiyo in the normal course of providing the Services.

2. COOKIES AND OTHER TRACKING TECHNOLOGIES  
Our Platform may utilise cookies and other tracking technologies. A "cookie" is a small text file that  
may be used to collect information about your activity on the Platform. Most browsers or devices allow  
you to control cookies, including whether to accept them and how to remove them. Please note that if  
you choose to erase or block cookies, you may need to re-enter your Personal Information to gain access  
to certain parts of the Platform.  
Tracking technologies may automatically record information such as Internet domain and host names,  
geographic location data, IP addresses, browser software and operating system types, click paths, and  
dates and times that the Platform is accessed. Our use of cookies and tracking technologies allows us to  
improve the Platform and your experience. We may also analyse aggregated, anonymised information  
for trends and statistical purposes. We do not use third-party advertising cookies.  
3. HOW WE COLLECT PERSONAL INFORMATION  
We may collect Personal Information from you in the following ways:  
directly, when you register on the Platform, create an Account or Child Profile, use the wellness  
tracking features, book a Consultation, upload photographs or records, or contact us for support;  
automatically, when you use the Platform, through technologies such as device identifiers, IP  
addresses, session logs, cookies (for web access), crash reports, diagnostic data, and usage  
patterns generated during your use of the Platform;  
from Practitioners, who may update Consultation records, upload prescriptions, or add clinical  
notes to a Child Profile following a Consultation; and  
from your interactions with the AI Wellness Assistant, which generates query and response  
logs in anonymised form.  
4. USES OF PERSONAL INFORMATION  
We process your Personal Information and Child Profile data for the following purposes:  
with your explicit consent, where required under applicable law, or where you have chosen to  
provide specific information or enable certain permissions (such as access to camera, photo  
gallery, or storage) for the purpose of providing the Services requested by you;  
for purposes that you acknowledge are necessary for us to provide and operate the Platform,  
including maintaining the Account and Child Profile, providing tracker reports, sending health  
and vaccine reminders, facilitating Consultations, and managing your Subscription;  
to share relevant Child Profile data with a Practitioner selected by the Primary Account Holder,  
solely to the extent required to facilitate a booked Consultation;  
to operate and improve the AI Wellness Assistant, using anonymised or pseudonymised  
interaction data;  
to improve, personalise, and optimise your experience on the Platform, including in-app  
features and recommendations;  
to process Subscription payments and Consultation fees, and to communicate with you about  
your Account or service-related matters;  
to send transactional notifications, including appointment confirmations, Subscription renewal  
reminders, and vaccine and health check-up alerts;  
to conduct analytics, troubleshooting, and research to understand usage patterns and improve  
Platform performance, using aggregated and anonymised data only;  
to provide customer support and resolve technical issues or user queries;  
to comply with applicable legal, regulatory, and law enforcement requirements, including  
responding to lawful court orders or governmental requests;  
to protect the safety and security of the Platform, including preventing fraud, spam, abuse,  
harmful content, unauthorised access, and security threats; and  
to verify your identity, device, and Account information, and to ensure the integrity of your  
login credentials.

Where we propose to use your Personal Information or Child Profile data for any purpose not listed  
above, we will notify you and provide you with the opportunity to withhold or withdraw your consent  
before such use commences.  
Mishiyo does not sell, rent, or trade Personal Information or Child Profile data to any third party.  
Mishiyo does not use Personal Information or Child Profile data for targeted advertising.  
5. WITHDRAWAL OF CONSENT  
You are entitled to withdraw consent for the processing of your Personal Information or Child Profile  
data by submitting a specific written request to: [email protected]. Withdrawal of consent with  
respect to all or any part of your Personal Information may result in the immediate withdrawal of your  
eligibility to avail certain or all Services, or may limit your access to certain features of the Platform.  
Your withdrawal of consent shall not operate to require us to cease any processing of Personal  
Information that is necessary for compliance with applicable law, or for purposes for which we may  
continue to store and use your Personal Information as mandated under applicable law, including the  
DPDPA.  
6. LEGAL BASIS FOR PROCESSING  
Mishiyo processes Personal Information on the following legal bases under the DPDPA and applicable  
Indian law:  
Consent: The Primary Account Holder provides informed, explicit consent at the time of  
Account registration and when creating a Child Profile. Consent in respect of Child Profile data  
is provided by the Primary Account Holder as the legal guardian of the minor child.  
Contractual Necessity: Processing necessary to perform the Services that the user has  
subscribed to, including Consultations, tracking features, health reminders, and content  
delivery.  
Legal Obligation: Retention of Consultation records, financial records, and other data as  
required by applicable medical, consumer protection, and data protection laws.  
Legitimate Interests: Processing for platform security, fraud prevention, improving Service  
quality, and ensuring safety of the Platform and its users, where such interests are not  
overridden by the rights and interests of the user or the minor child concerned.  
7. CONFIDENTIALITY AND SECURITY  
We will keep confidential and protect your Personal Information and Child Profile data, except where  
disclosure is required or permitted by law.  
We implement and maintain industry-standard security measures to protect the Personal Information  
we hold, both during transmission and upon receipt, including:  
all data is stored on Amazon Web Services (AWS) infrastructure hosted exclusively in India  
(AWS ap-south-1, Mumbai region);  
all data, including Child Profile data and photographs, is encrypted at rest using AES-256  
encryption and in transit using Transport Layer Security (TLS) 1.2 or higher;  
access to Personal Information and Child Profile data within Mishiyo is restricted to authorised  
personnel on a strict need-to-know basis, with role-based access controls;  
regular security assessments, penetration testing, and vulnerability reviews are conducted; and  
a data breach response procedure is in place, and in the event of a breach affecting Personal  
Information, affected users will be notified in accordance with the requirements of the DPDPA  
and other applicable law.  
However, no method of transmission over the Internet or method of electronic storage is one hundred  
percent (100%) secure, and we cannot guarantee the absolute security of your Personal Information.  
We limit access to Personal Information to employees and authorised service providers who need to  
come into contact with such information to provide the Services or carry out their functions.

We may process certain metadata, diagnostic data, and device information to detect spam, fraud,  
harmful activity, and unauthorised access. This processing enables us to protect the integrity of the  
Platform and ensure user safety, and may involve automated systems or algorithms that identify  
suspicious patterns or misuse.  
8. DATA SHARING AND DISCLOSURE  
8.1 Practitioners  
When a Consultation is booked by the Primary Account Holder, the relevant portions of the Account  
and Child Profile, to the extent necessary to conduct the Consultation, are shared with the selected  
Practitioner. Practitioners are independently licensed professionals and are subject to their own  
professional obligations of confidentiality under applicable medical laws and regulations. The Company  
is not responsible for a Practitioner's use of information shared in the context of a Consultation.  
8.2 Cloud Infrastructure Provider  
The Company uses Amazon Web Services (AWS) for data storage and hosting. AWS is engaged as a  
data processor and is contractually bound to process data only on the Company's instructions and to  
maintain appropriate security and confidentiality standards. All data is hosted within India at all times.  
8.3 Payment Gateway Providers  
Payment processing is handled by third-party licensed payment gateway providers. Transaction  
identifiers and Subscription status are shared with the payment gateway to the minimum extent  
necessary for payment processing. Full payment card or banking credentials are neither transmitted to  
nor stored by Mishiyo.  
8.4 Legal Disclosure  
Mishiyo may disclose Personal Information to courts, law enforcement agencies, governmental  
authorities, or regulatory bodies where required by a court order, applicable law, or valid governmental  
request. Where legally permissible, Mishiyo will endeavour to notify the user before making such  
disclosure. Mishiyo may also share information, including your identity, with relevant authorities in  
connection with the investigation of alleged illegal activity or in response to a lawful subpoena.  
8.5 Business Transfers  
In the event that ownership or control of the Company were to change, including by way of merger,  
acquisition, amalgamation, or sale of business, your Personal Information and Child Profile data may  
be transferred to the acquirer or successor entity. If such a transfer results in a material change in the  
use of your Personal Information, Mishiyo will provide notice of the choices available to you in respect  
of such transfer.  
8.6 No Sale of Data  
Mishiyo does not sell, rent, trade, or otherwise commercially exploit Personal Information or Child  
Profile data. Personal Information and Child Profile data are not shared with third parties for advertising,  
behavioural profiling, or marketing purposes.  
8.7 Aggregated Data  
Mishiyo may share aggregated, non-personally identifiable statistical and analytical data with third  
parties for research, product improvement, or commercial purposes including without limitation  
advertising. Such data does not identify any individual user or child and is not Personal Information.  
9. DATA RETENTION  
We retain Personal Information and Child Profile data for as long as is necessary to provide the Services  
and to comply with our legal obligations. The following specific retention periods apply:

10. STORAGE AND INTERNATIONAL DATA TRANSFERS  
All Personal Information collected through the Platform is stored and processed in India, exclusively  
on AWS infrastructure located in the Mumbai region. Mishiyo does not transfer Personal Information  
outside India as part of its standard operations.  
If Mishiyo expands its Services to international markets, including the Middle East or other regions,  
any cross-border processing of Personal Information shall be conducted in accordance with the  
provisions of the DPDPA governing cross-border data transfers, and any applicable regulations or  
notifications issued thereunder. Users will be notified of any material change to cross-border data  
transfer practices before such practices commence, and appropriate safeguards shall be put in place in  
accordance with applicable law.  
11. CHILDREN AND CHILD PROFILE DATA  
11.1 Nature of Child Data  
The Platform is designed for use by adults (parents and caregivers) and is not intended for direct use by  
children. The child does not create an Account or independently interact with the Platform. All data  
relating to a child is entered and managed by the Primary Account Holder or an authorised Sub-User.  
The Company applies enhanced data protection measures to all Child Profile data, recognising its  
particularly sensitive nature.  
11.2 Parental Responsibility

By creating a Child Profile, the Primary Account Holder represents and warrants that she is the  
biological mother, adoptive mother, or duly authorised legal guardian of the child, and that she is legally  
entitled to consent to the collection, storage, and processing of the child's personal data on that child's  
behalf in accordance with the DPDPA. The Primary Account Holder shall bear full responsibility for  
the accuracy of all information entered into a Child Profile.  
11.3 Data Rights of the Child Upon Reaching the Age of Majority  
When a child whose Personal Information is stored in a Child Profile on the Platform reaches eighteen  
(18) years of age, that individual acquires full and independent status as a Data Principal under  
applicable Indian data protection law. Upon reaching the age of majority, the individual shall have the  
following rights with respect to their Personal Information:  
the right to access all personal data held in their Child Profile;  
the right to request correction of any inaccurate or incomplete data;  
the right to request erasure of their personal data, subject to applicable legal retention  
obligations, with erasure to be completed within timelines prescribed under applicable law; and  
the right to withdraw consent for the continued processing of their personal data.

12. THIRD PARTY PLATFORMS  
If you click on a link to a third-party website or platform, or otherwise leave the Platform, you will  
access a website or platform that is outside the purview of the Company's control. As the Company  
cannot control the activities of third parties, it cannot accept responsibility for any use of your Personal  
Information by such third parties, and cannot guarantee that they will adhere to the same privacy and  
security practices. The use of Personal Information by such third-party platforms shall be governed by  
their own privacy policies. If you visit a third-party platform linked to or from the Platform, you should  
consult that platform's privacy policy before providing any Personal Information.  
13. CONTACTING YOU  
We may contact you using the Personal Information you have provided to us:  
in relation to the functioning of any Services you have subscribed to or accessed, including  
Subscription billing, Consultation confirmations, and health reminders;  
where you have opted to receive further communications or promotional materials from us;  
to invite you to participate in surveys or opinion polls about our Services (participation is  
always voluntary); and  
to provide you with information about new features, products, or Services where you have  
specifically agreed to receive such information.  
14. AI WELLNESS ASSISTANT AND DATA PROCESSING  
The AI Wellness Assistant uses human-trained machine learning models to generate general, non-  
clinical responses to parenting and childcare queries. The following governs the processing of data in  
connection with the AI Wellness Assistant:  
conversations with the AI Wellness Assistant may be reviewed by authorised Company  
personnel to improve model accuracy, safety, and quality of responses;  
interaction logs are retained in anonymised or pseudonymised form for a maximum of twelve  
(12) months for model training and improvement purposes;  
no AI Wellness Assistant interaction data is used for advertising, profiling, or shared with any  
third party; and  
the AI Wellness Assistant does not make clinical decisions, diagnoses, or treatment  
recommendations, and its outputs do not constitute medical advice.  
The AI Wellness Assistant involves automated processing of your queries to generate responses. This  
automated processing does not produce legally significant decisions or decisions that otherwise  
significantly affect you or your child. All clinical and health-critical decisions on the Platform are made  
exclusively by human Practitioners during booked Consultations.

15. ACCURACY  
To the extent that you provide us with Personal Information or Child Profile data, we wish to maintain  
accurate and current records. Should you need to update or correct any Personal Information or Child  
Profile data, please contact us and we will make reasonable efforts to incorporate the changes as soon  
as practicable. You may contact us for this purpose at: [email protected]. We will use our best efforts  
to send you confirmation of the action taken within fifteen (15) days of receipt of your request.  
16. YOUR RIGHTS AS A DATA PRINCIPAL  
The Primary Account Holder has the following rights with respect to Personal Information and Child  
Profile data held by Mishiyo, in accordance with the DPDPA and applicable law:  
Right to Access: You may request a copy of the Personal Information and Child Profile data  
we hold about you and your child.  
Right to Correction: You may request that inaccurate or incomplete data be corrected or  
completed.  
Right to Erasure: You may request deletion of Personal Information and Child Profile data,  
subject to applicable legal retention obligations.  
Right to Withdraw Consent: You may withdraw consent for the processing of your Personal  
Information at any time. Withdrawal of consent does not affect the lawfulness of processing  
conducted before withdrawal. Withdrawal of consent may affect your ability to access certain  
or all Services.  
Right to Grievance Redressal: You may lodge a complaint with the Company's Grievance  
Officer as set out in Section 18 below.  
All requests for exercise of data rights should be submitted to [email protected]. The Company  
may require verification of identity before processing any such request.  
17. CONSENT AND AMENDMENTS  
By using the Platform, you consent to the terms of this Policy and to our collection, use, storage, and  
management of Personal Information and Child Profile data for the purposes and in the manner  
described herein.  
Mishiyo may update this Policy at any time to reflect changes in law, our data practices, or our Services.  
Where changes are material, Mishiyo will endeavour to notify users by email or in-app notification with  
prior reasonable notice, and will update the "Effective Date" at the top of this Policy. Please review this  
Policy from time to time. Your continued use of the Platform and the Services following the posting of  
any changes constitutes your acceptance of the revised Policy. If you object to any change, you must  
discontinue use of the Platform.  
Your visit to the Platform and any dispute over privacy are subject to this Policy and to the Terms of  
Use of the Platform.  
18. GRIEVANCE REDRESSAL  
In the event you have any complaints or grievances in respect of our processing of your Personal  
Information or Child Profile data, or concerning any dispute or disagreement arising out of this Policy,  
such complaints or grievances may be sent to our Grievance Officer at the coordinates set out below.  
Any complaint or grievance raised by you must include the following information:  
the subject line or heading marked as "Personal Information Grievance";  
your name and contact details, including address, contact number, and email address;  
a description of the complaint or grievance; and  
a statement that the information provided in the complaint is accurate.

We will acknowledge each request within twenty-four (24) hours and resolve complaints within

19. APPLICABLE LAW  
This Policy and all information contained herein shall be governed by the laws of India. The courts of  
Bengaluru, Karnataka shall retain exclusive jurisdiction to entertain any proceedings in relation to  
disputes arising out of or in connection with this Policy.  
WARRANTY DISCLAIMER  
This Policy is only a description of our operation regarding your Personal Information.  
WE DO NOT WARRANT THAT THE PLATFORM, ITS SERVERS, OR COMMUNICATIONS  
SENT BY OR ON BEHALF OF THE COMPANY ARE FREE OF VIRUSES OR OTHER HARMFUL  
COMPONENTS.  
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY WILL  
NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ITS  
PLATFORM OR SERVICES, INCLUDING BUT NOT LIMITED TO COMPENSATORY, DIRECT,  
INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY AND CONSEQUENTIAL  
DAMAGES, LOSS OF DATA, GOODWILL, BUSINESS OPPORTUNITY, INCOME OR PROFIT,  
LOSS OF OR DAMAGE TO PROPERTY, AND CLAIMS OF THIRD PARTIES.  
IN THE EVENT OF ANY PERSONAL INFORMATION BREACH, THE COMPANY SHALL
